Terms of Service

Please read these terms carefully before engaging our services. By working with H & J Framing Inc, you agree to the following conditions.

Acceptance of Terms

By requesting a quote, signing a contract, or engaging the services of H & J Framing Inc ("Company," "we," "us," or "our"), you ("Client," "you") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not engage our services.

These Terms of Service apply to all residential and commercial construction services provided by H & J Framing Inc, based in Lynn, MA, operating throughout Greater Boston and surrounding areas.

Important: A signed contract or written confirmation of a project proposal constitutes your acceptance of these Terms of Service in full.

Services Provided

H & J Framing Inc provides the following residential and light-commercial construction services:

  • Structural framing (new construction and renovation)
  • Home additions and extensions
  • Deck design and construction
  • Porch construction (front, wraparound, and screened)
  • Exterior siding installation and replacement
  • Roof installation and replacement

The specific scope of work for each project is defined in the individual written contract or proposal issued to the Client. Services not expressly listed in the contract are not included and may be subject to additional fees.

Estimates & Proposals

All estimates and proposals provided by H & J Framing Inc are based on information available at the time of assessment. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.

Estimates are not binding contracts. A binding agreement is only established upon the execution of a written contract signed by both parties. Final pricing may differ from estimates due to unforeseen site conditions, material price fluctuations, or changes in project scope requested by the Client.

  • Estimates are provided free of charge.
  • On-site assessments may be required before a final estimate can be issued.
  • Material costs are subject to market fluctuations; significant changes may affect final pricing.

Payment Terms

Payment schedules are outlined in each individual project contract. Standard payment terms are as follows:

  • Deposit: A deposit of up to 30% of the total contract value is required to secure your project start date and cover initial materials.
  • Progress Payments: Payments tied to project milestones (as defined in your contract) are due within 5 business days of each milestone completion.
  • Final Payment: The remaining balance is due upon substantial completion of the project.

Accepted payment methods include check, bank transfer (ACH), and cash. We do not currently accept credit card payments unless otherwise arranged in writing.

Late Payments: Invoices not paid within 10 days of their due date may be subject to a late fee of 1.5% per month on the outstanding balance. H & J Framing Inc reserves the right to suspend work on any project with overdue invoices.

Changes & Change Orders

Any changes to the agreed-upon scope of work must be requested in writing and acknowledged by H & J Framing Inc through a formal Change Order. No additional work will be performed without a signed Change Order specifying the additional cost and any impact to the project schedule.

  • Change Orders may affect the project timeline and total cost.
  • Verbal agreements for scope changes are not binding.
  • Changes requested by Client-appointed third parties (architects, engineers) must still be authorized in writing by the Client.

Project Timeline

Project start dates and estimated completion timelines are provided in good faith and are subject to change due to factors including but not limited to:

  • Weather conditions (particularly relevant in New England)
  • Material lead times and supply chain delays
  • Permit approval delays by local authorities
  • Changes to project scope requested by the Client
  • Unforeseen site conditions (rot, structural issues, utilities)

H & J Framing Inc will communicate any significant delays to the Client as soon as they are identified. Time extensions resulting from Client-caused delays may result in additional costs.

Site Access & Safety

The Client agrees to provide H & J Framing Inc and its subcontractors with reasonable and safe access to the project site during agreed working hours (Monday through Saturday, 7:00 AM to 6:00 PM, unless otherwise arranged).

  • The Client is responsible for ensuring pets and unauthorized individuals are kept away from the work area.
  • H & J Framing Inc will maintain a clean and organized job site and dispose of construction debris in a responsible manner.
  • The Client shall notify H & J Framing Inc of any known site hazards (underground utilities, asbestos, lead paint, etc.) prior to commencement of work.

Permits & Building Codes

H & J Framing Inc will obtain all building permits required for the scope of work as specified in the project contract, unless otherwise agreed upon in writing. Permit fees are typically included in the project estimate; however, any unforeseen permit costs will be communicated to the Client prior to application.

All work performed by H & J Framing Inc will comply with applicable Massachusetts State Building Code and local municipal requirements. The Client is responsible for obtaining any required homeowner association (HOA) approvals prior to project commencement.

Warranties

H & J Framing Inc stands behind our workmanship. We provide the following warranty coverage:

  • Workmanship Warranty: 1 year on all labor from the date of substantial project completion.
  • Materials Warranty: Material warranties are passed through from the manufacturer (e.g., shingle warranties from GAF, Owens Corning; siding warranties from James Hardie, LP SmartSide). Client must retain product documentation.
Warranty Exclusions: Warranties do not cover damage resulting from Acts of God (storms, flooding, earthquakes), normal wear and tear, improper maintenance by the Client, unauthorized modifications to completed work, or pre-existing conditions not disclosed prior to project commencement.

Limitation of Liability

To the maximum extent permitted by applicable law, H & J Framing Inc's total liability to the Client for any claims arising out of or related to services provided shall not exceed the total amount paid by the Client under the relevant project contract.

H & J Framing Inc shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of income, or cost of temporary housing, even if advised of the possibility of such damages.

H & J Framing Inc carries general liability insurance and workers' compensation insurance as required by the Commonwealth of Massachusetts. A certificate of insurance is available upon request.

Dispute Resolution

In the event of a dispute arising out of or relating to these Terms of Service or any project contract, the parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation fails within 30 days, the parties agree to submit the dispute to mediation before pursuing any legal action.

Any unresolved disputes shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association, held in Essex County, Massachusetts.

Termination

Either party may terminate a project contract with 14 days' written notice. Upon termination:

  • The Client shall pay H & J Framing Inc for all work completed and materials procured up to the date of termination.
  • H & J Framing Inc will provide the Client with a final accounting of all costs incurred.
  • Any deposit paid is non-refundable to the extent it covers costs already incurred.

H & J Framing Inc reserves the right to terminate a contract immediately and without notice in cases of Client non-payment, unsafe site conditions, or conduct that prevents the safe performance of work.

Governing Law

These Terms of Service and any project contracts between H & J Framing Inc and the Client shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

H & J Framing Inc operates as a licensed contractor in the Commonwealth of Massachusetts. Our Home Improvement Contractor (HIC) registration information is available upon request.
